Terms & Conditions

This agreement governs your access to and use of the PrimeEstate platform. Kindly review these terms thoroughly before proceeding to use our services.

PrimeEstate Realty Pvt. Ltd. ("PrimeEstate", "we", "us") operates this platform as a curated real estate information and transaction facilitation service. By browsing, registering, or engaging our services — whether as a buyer, seller, investor, dealer, or visitor — you unconditionally accept the terms set out herein. These terms form a legally enforceable agreement under the Indian Contract Act, 1872 and the Information Technology Act, 2000. If any clause is unacceptable to you, please cease using the Platform immediately.

Throughout this agreement, the following terms carry the meanings assigned below:

  • Registered User / Subscriber — Any individual or legal entity that has created a verified account on the Platform, whether on a complimentary or paid subscription basis, accessing services via designated login credentials.
  • Visitor / Browser — A person who accesses publicly available sections of the Platform without creating an account or establishing login credentials.
  • Advertiser / Lister — A Subscriber who uploads, publishes, or promotes property content through the Platform's listing or advertising tools.
  • Platform — The PrimeEstate website (primeestate.in), all subdomains, mobile applications, smart device interfaces, APIs, and any other digital surface operated by PrimeEstate.
  • Services — The full range of features offered via the Platform, including but not limited to property search, listing management, advisory consultations, lead generation, investment analysis, and transaction support. PrimeEstate functions as an information bridge and does not act as an agent — express or implied — on behalf of any party.
  • RERA / RERDA — The Real Estate (Regulation and Development) Act, 2016, along with all rules, notifications, and state-level amendments issued thereunder.
  • Unauthorised User — Any person accessing the Platform without a valid legal or contractual basis. Such individuals remain subject to all obligations herein, particularly those concerning intellectual property and lawful conduct.

The terms "User" and "Customer" encompass both Registered Users and Visitors unless explicitly stated otherwise.

Users submitting property listings or advertisements to the Platform confirm and warrant the following:

  • They hold full authority — either as the registered owner or as a duly appointed power-of-attorney holder — to advertise the property in question.
  • All photographs, descriptions, financial figures, and supporting materials included in any listing have been provided with the consent of their respective rights-holders.
  • Where RERA is applicable, all mandatory project registrations, sanctions, and regulatory clearances from competent authorities have been secured prior to submission.
  • All disclosed information — including dimensions, ownership status, encumbrances, title history, and property type — is factually accurate and free from material omission.
  • Properties listed for sale or rent are genuinely available and are not subject to undisclosed legal disputes, court orders, or pending litigation.

PrimeEstate does not perform independent legal verification of property titles or statutory compliance. A "Verified" tag on any listing solely confirms the physical existence of the property as described and must not be construed as an endorsement of ownership, title clarity, or document authenticity. Prospective buyers and tenants must independently conduct due diligence. PrimeEstate reserves the right to remove any listing at its sole discretion, without prior notice, if it is found to be in violation of these terms or applicable law.

Users consent to PrimeEstate and its affiliates using any submitted content — including text, images, and data — for platform operations, promotional materials, and service improvement, without compensation, unless otherwise agreed in writing.

All paid services on the Platform are governed by the following financial terms:

  • Advance Payment Requirement: Subscription and service fees are payable in full prior to activation. No credit terms are extended unless covered by a separate written agreement.
  • Non-Refundability: Once a subscription is activated or a service order is confirmed, all payments made become non-refundable. Any discretionary refund, if considered at all, shall be solely at PrimeEstate's determination and will be processed without any guaranteed timeline.
  • Failed Transactions: In the event of a payment failure or duplicate charge, PrimeEstate's reconciliation team will endeavour to resolve and process eligible refunds promptly. However, given the involvement of third-party banking networks, payment gateways, and financial institutions, PrimeEstate cannot guarantee the speed or accuracy of such reversals.
  • Subscription Activation Windows: For broker accounts, subscriptions must be activated within 30 days of the service order approval date. For developer accounts, this window extends to 60 days. Activation requests submitted beyond these periods will not be entertained and paid amounts will stand appropriated.
  • EMI Arrangements: If a User elects to pay through an EMI facility offered by a financial institution, PrimeEstate will receive the full subscription amount upfront from the institution. PrimeEstate is not a party to any EMI agreement between the User and their lender.
  • Cash Payments Prohibited: Transactions must be conducted via authorised digital or banking channels. Cash payments — whether tendered to PrimeEstate representatives or deposited directly into any PrimeEstate account — will be deemed void and shall not discharge the User's payment obligation.
  • Set-Off Rights: PrimeEstate reserves the right to set off any amounts owed by a User against outstanding dues payable to PrimeEstate under any existing or prior commercial arrangement.

Unused entitlements within an active subscription period cannot be carried forward or extended beyond the validity window, except at PrimeEstate's express written consent.

PrimeEstate grants Users a limited, non-exclusive, non-transferable, revocable right to access and use the Platform solely for lawful, personal, and non-commercial real estate enquiry and transaction purposes. The following conduct is expressly prohibited and shall result in immediate account suspension, termination, and potential legal action:

  • Deploying bots, crawlers, scrapers, spiders, automated scripts, browser plug-ins, or any equivalent tools to harvest, duplicate, or extract data from the Platform without explicit written authorisation.
  • Attempting to gain unauthorised access to secured sections of the Platform, user accounts, internal servers, or administrative systems through hacking, credential stuffing, or any other technique.
  • Reproducing, distributing, or commercialising any Platform content — including property listings, photographs, data compilations, or analytical reports — outside of the Platform without prior written permission.
  • Using the Platform to build or operate a competing service, to resell PrimeEstate's products, or to extend Platform access to unlicensed third parties.
  • Impersonating another person, entity, or real estate professional; submitting fabricated listings or fraudulent enquiries; or misrepresenting financial capacity or transaction intent.
  • Reverse-engineering, decompiling, deciphering, or attempting to derive the source code of any software component underlying the Platform.
  • Transmitting unsolicited bulk communications, spam, or phishing content to other Users or to PrimeEstate.
  • Uploading or distributing malware, viruses, trojan programs, or any code designed to disrupt, damage, or compromise the Platform or its infrastructure.
  • Publishing or sharing content that is defamatory, obscene, threatening, communally divisive, or in violation of any applicable Indian law including the IT Act, 2000 and its amendments.
  • Circumventing PrimeEstate's brokerage facilitation by directly transacting with a counterparty first introduced through the Platform without discharging applicable service fees.

PrimeEstate monitors Platform activity and reserves the right to report suspected illegal conduct to law enforcement authorities and to fully cooperate with any resulting investigation.

Where PrimeEstate runs cost-per-lead (CPL) campaigns on behalf of registered developers or broker partners, the following conditions apply:

  • PrimeEstate will make commercially reasonable efforts to deliver the agreed volume of leads at the mutually negotiated per-lead cost. Channel selection and campaign deployment remain at PrimeEstate's sole operational discretion.
  • A "lead" constitutes contact information of a platform user who has specifically expressed interest in or consented to being contacted about properties or projects listed on the Platform.
  • If the same lead is submitted again for the same project within 30 calendar days of the original lead date, it will be classified as a duplicate and excluded from billable count. All other leads shall be treated as unique.
  • PrimeEstate bears no responsibility for, and makes no representation regarding, the conversion rate of delivered leads or the outcome of any transaction initiated from a lead.
  • Customers receiving leads are solely responsible for complying with all applicable data privacy laws — including the Digital Personal Data Protection Act, 2023 — with respect to the personal information of individuals whose details have been shared.
  • All amounts paid or committed for CPL campaigns are strictly non-refundable, regardless of campaign outcome.
  • PrimeEstate may suspend or terminate a campaign upon fulfilment of the agreed lead count, non-payment, or breach of these terms, without liability to the Customer.

PrimeEstate processes personal data in accordance with its Privacy Policy and the Digital Personal Data Protection Act, 2023 (DPDPA). By using the Platform, you acknowledge and consent to the following:

  • When you submit an enquiry, express interest in a listing, or register on the Platform, your profile — including contact details, search preferences, and application information — may be shared with relevant property sellers, developers, brokers, and financial service providers.
  • You authorise PrimeEstate to reach out to you regarding property recommendations and related services, including via phone, email, SMS, and messaging applications, even if your number is registered under the National Consumer Preference Register (NCPR/DNC).
  • Information you publish on your public profile or in listing responses may be visible to other Users globally. Avoid sharing sensitive personal or financial information in public-facing fields.
  • PrimeEstate may employ proprietary and third-party AI tools to review and moderate content on the Platform. This automated process may be complemented by human review for complex cases. Users may raise grievances against moderation decisions via PrimeEstate's designated grievance mechanism.
  • Your data will be retained for the duration required to fulfil contractual obligations or as mandated by applicable law. You may request access, correction, or deletion of your data by writing to privacy@primeestate.in.
  • PrimeEstate does not sell personal data. However, once data is lawfully shared with third-party partners, PrimeEstate's privacy policy ceases to govern the third party's use of that data.

Dealers, builders, banks, and institutional partners receiving user data from PrimeEstate are independently obligated to maintain data security, process data only for agreed purposes, and not transfer it to sub-processors without equivalent safeguards.

All trademarks, service marks, logos, trade names, platform design, proprietary databases, content compilations, software architecture, and visual identity elements displayed on the Platform are the exclusive property of PrimeEstate Realty Pvt. Ltd. or are used under licence from their respective owners. These are protected under the Trade Marks Act, 1999, the Copyright Act, 1957, and all other applicable Indian intellectual property statutes.

Access to the Platform does not transfer, assign, or grant any ownership right or licence in any intellectual property to the User. Specifically, Users may not:

  • Copy, republish, or commercially exploit any content from the Platform without prior written consent.
  • Remove, alter, or obscure any copyright notices, trademark symbols, or proprietary legends displayed on or within the Platform.
  • Frame, mirror, or simulate the appearance of the Platform on any third-party website or application.
  • Create derivative content, alternate databases, or analytics products using Platform data without express written authorisation from PrimeEstate's legal team.

Users found to be infringing the intellectual property rights of PrimeEstate or any third party through the Platform will have their accounts terminated immediately without notice, and PrimeEstate reserves the right to pursue all available civil and criminal remedies.

The Platform and all Services are made available on a strictly "as is" and "as available" basis. PrimeEstate makes no representation or warranty of any kind — express, implied, or statutory — including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or uninterrupted availability.

  • PrimeEstate does not endorse, verify, or guarantee the quality, legal status, financial viability, or suitability of any property listed on the Platform.
  • Views, comments, and representations made by Users or third-party advertisers are their own. PrimeEstate bears no responsibility for such content.
  • Pre-launch project listings, off-plan investments, and unregistered developments are displayed for informational purposes only. Users engaging with such projects do so entirely at their own risk. PrimeEstate strongly advises independent verification of all regulatory approvals before committing any funds.
  • PrimeEstate does not guarantee server uptime, application functionality, or data accuracy at all times. Temporary outages may occur for maintenance, upgrades, or reasons beyond our control.
  • Nothing on the Platform constitutes financial, legal, or investment advice. Users must seek independent professional counsel before making any property-related decision.

To the fullest extent permitted under applicable Indian law, PrimeEstate shall not be held liable for any loss, damage, or expense — whether direct, indirect, consequential, incidental, special, or punitive — arising from or in connection with:

  • Reliance on information, listings, or data published on the Platform.
  • Any transaction entered into between a buyer and a seller, even if originally facilitated through the Platform.
  • Platform outages, technical failures, data loss, or cyber incidents not within PrimeEstate's reasonable control.
  • Inaccuracies, omissions, or misrepresentations in User-submitted content.
  • Unauthorised access to or alteration of User account information.
  • Acts of Force Majeure including natural disasters, pandemics, governmental actions, or internet infrastructure failures.

Where PrimeEstate is determined to bear liability under any applicable legal framework, the maximum aggregate compensation payable by PrimeEstate shall be capped at the subscription or service fees actually received from the claiming User during the three months immediately preceding the event giving rise to the claim. For the purposes of the Consumer Protection Act, 2019, "Consumer" shall be limited to individual Users who have subscribed solely for personal, non-commercial purposes.

PrimeEstate operates as a duly registered real estate agent under the Real Estate (Regulation and Development) Act, 2016. Our state-wise registrations include:

  • Maharashtra RERA Agent Registration: A52100XXXXXXX
  • Delhi RERA Agent Registration: DLRERA2020AGXXXX
  • Karnataka RERA Agent Registration: PRM/KA/RERA/XXXXXX

In fulfilment of our disclosure obligations:

  • PrimeEstate does not guarantee, project, or represent any return on investment with respect to any listed property.
  • Project-specific regulatory data is derived from the developer's own RERA filings. Buyers should independently cross-verify this information on the relevant state RERA portal before committing to any purchase.
  • PrimeEstate strongly advises against investment in projects that have not received official governmental sanction or that remain in an unapproved pre-launch phase. Any such engagement is entirely at the User's own risk and responsibility.

PrimeEstate may, at any time and without prior notice, suspend, restrict, or permanently terminate a User's access to the Platform if, in PrimeEstate's reasonable judgement, the User has:

  • Violated any provision of these Terms or acted contrary to their spirit and intent.
  • Submitted fraudulent, misleading, or non-compliant listings or enquiries.
  • Engaged in conduct that causes harm — reputational, financial, operational, or legal — to PrimeEstate, its employees, or other Users.
  • Repeatedly breached platform guidelines following prior warnings.
  • Engaged in any transaction or activity that lacks transparency, raises authenticity concerns, or violates applicable Indian law.

Termination of access does not relieve the User of any outstanding payment obligations, indemnification duties, or legal liabilities arising prior to the date of termination. PrimeEstate reserves all rights to pursue recovery through legal channels.

You agree to fully defend, indemnify, and keep harmless PrimeEstate Realty Pvt. Ltd., its directors, officers, employees, legal representatives, affiliates, and platform partners from and against any and all claims, demands, suits, proceedings, penalties, losses, costs, and expenses (including reasonable legal and accounting fees) arising from or attributable to:

  • Your use or misuse of the Platform or any Services offered therein.
  • Any content, listing, or data you have submitted to the Platform that infringes the rights of a third party or violates any applicable law.
  • Your breach — actual or alleged — of any representation, warranty, or obligation set forth in these Terms.
  • Actions taken by any person operating under your account credentials, whether authorised by you or not.

PrimeEstate is not a party to disputes between Users or between a User and a third party, and will not intervene in such matters. If PrimeEstate is nonetheless named in any legal proceedings as a consequence of a User's actions, the cost of defending against such proceedings shall be recovered from the User responsible for initiating or causing such implication.

These Terms and all matters arising from them shall be interpreted, construed, and enforced in accordance with the laws of the Republic of India. In the event of any dispute between a User and PrimeEstate, the following resolution framework shall apply:

  • Phase 1 — Direct Resolution: Both parties shall make a sincere, good-faith attempt to resolve the matter through direct dialogue within 30 days of the initial written complaint.
  • Phase 2 — Arbitration: If direct resolution fails, the dispute shall be referred to a single, mutually agreed-upon arbitrator. The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996, with Mumbai as the designated seat. The arbitrator's award shall be final and binding on both parties.
  • Phase 3 — Courts: For interim injunctive relief or enforcement of an arbitral award, the courts situated in Mumbai, Maharashtra shall have exclusive jurisdiction. By using the Platform, all Users expressly submit to this jurisdiction, regardless of their location at the time of access.

For disputes specifically governed by RERA, the jurisdiction of the relevant State Real Estate Regulatory Authority is expressly preserved and is not displaced by this arbitration clause.

Modifications: PrimeEstate may revise these Terms at any time. Revised Terms will be published on the Platform with an updated effective date. Continued use of the Platform after any revision constitutes your binding acceptance of the updated Terms. We recommend reviewing this page periodically.

Severability: Should any provision of these Terms be found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that specific provision shall be deemed severed from these Terms. The remaining provisions shall continue in full force and effect without impairment.

No Waiver: PrimeEstate's failure to enforce any right or provision under these Terms at any given time shall not constitute a permanent waiver of that right or provision. PrimeEstate retains the right to enforce any provision at any subsequent time.
